Terms and Conditions of Use

Anyclazz S.L.

These Terms and Conditions govern access to and use of the Anyclazz platform and related services. By creating an account, browsing, booking, offering, or using the platform, you agree to be bound by these Terms.

Anyclazz S.L. ("Anyclazz") operates an online platform that connects teachers and students for educational services.

2. Nature of the Service

Anyclazz is a digital marketplace that facilitates contact, discovery, scheduling, and payment processing between independent teachers and students.

  • Anyclazz is not the provider of the classes or educational services listed on the platform.
  • Teachers act as independent professionals and are solely responsible for the services they offer and deliver.
  • Anyclazz does not guarantee the quality, legality, suitability, credentials, results, or outcomes of any class, teacher, or student interaction.

3. Eligibility, Age Requirements, and User Accounts

To use the platform, users must create an account and provide accurate, complete, and up-to-date information.

  • Users under 13 years of age may not create an account or use the platform.
  • Users between 13 and 17 years of age may use the platform only with the consent and supervision of a parent or legal guardian and only where permitted by applicable law.
  • Anyclazz may request information reasonably necessary to verify age, identity, authority, or consent.
  • Teachers must be legally permitted to provide their services and to receive payments in their jurisdiction. Where applicable law requires it, teachers must be at least 18 years old.
  • Users are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their accounts.

Anyclazz reserves the right to suspend, restrict, or terminate any account in cases of suspected fraud, underage use, inaccurate information, abusive conduct, legal risk, or violation of these Terms.

4. Platform Use Rules

Users agree not to:

  • Engage in unlawful, abusive, deceptive, harmful, or fraudulent conduct
  • Upload, post, transmit, or otherwise make available content that is illegal, infringing, offensive, misleading, or inappropriate
  • Attempt to bypass the platform to arrange payments or classes outside Anyclazz where such conduct violates platform rules or active promotional terms
  • Infringe intellectual property rights, privacy rights, publicity rights, or other rights of third parties
  • Interfere with the operation, security, or integrity of the platform or attempt unauthorized access to accounts, data, or systems
  • Use automated means, scraping tools, bots, or similar mechanisms except where expressly authorized by Anyclazz in writing

Anyclazz may review content, investigate conduct, remove listings or materials, limit functionality, and restrict access where necessary to protect users, the platform, or compliance obligations.

5. Booking, Payments, Commission, and Subscription Terms

5.1 Pricing

Teachers set their own prices for classes unless the platform expressly provides otherwise.

5.2 Payments

Payments are processed through third-party payment providers, such as Stripe Connect or successors. Teachers receive payouts through the payment provider subject to that provider's onboarding, verification, payout schedules, holds, fees, and terms.

5.3 Commission

Anyclazz charges teachers a standard commission of 22% on each completed class, except where a different rate is expressly disclosed by Anyclazz before the applicable booking or during a clearly identified promotional offer.

  • If Anyclazz advertises or displays a reduced commission for a teacher's first completed class, that reduced commission applies only to the class, teacher, student relationship, timeframe, and conditions expressly described in the relevant promotion or onboarding flow.
  • After the promotional or introductory class, the standard 22% commission applies unless Anyclazz expressly discloses another applicable rate before the transaction.
  • Promotional or introductory rates are not guaranteed to continue and may be modified, limited, or withdrawn prospectively, provided the applicable rate is disclosed before the relevant booking is confirmed.

5.4 Subscription (Super Tutor)

Anyclazz may offer an optional paid subscription, such as "Super Tutor," to increase visibility or unlock additional features.

  • The subscription price, billing frequency, renewal term, included benefits, and any trial period will be clearly presented before purchase.
  • Unless otherwise stated at checkout, the subscription renews automatically at the end of each billing period until canceled.
  • Users may cancel renewal at any time through their account settings or by contacting support before the next renewal date. Cancellation stops future renewals but does not retroactively reverse charges already validly incurred for the current billing period, except where required by law.
  • Anyclazz will provide the disclosures required by applicable automatic renewal and consumer protection laws before purchase, including for users located in California or other jurisdictions with specific subscription disclosure requirements.
  • Any refund rights for subscription fees will be stated at checkout or in a specific subscription offer and will apply in addition to any non-waivable rights under applicable law.

6. Cancellation and Refund Policy

6.1 Student Cancellations

Students may cancel a class up to 24 hours before the scheduled start time unless a different cancellation window is clearly disclosed before booking.

6.2 Late Cancellations

Cancellations made within 24 hours of the scheduled class time are generally non-refundable unless applicable law requires otherwise or Anyclazz expressly approves an exception.

6.3 Teacher Cancellation or No-Show

If a teacher cancels or fails to attend a confirmed class, the student will be entitled to an appropriate remedy, which may include rescheduling, credits, or a full refund, as determined by Anyclazz or the payment provider rules applicable to the transaction.

6.4 Refund Processing

Refunds, reversals, and charge adjustments are processed through the payment provider and may be subject to the provider's timelines, controls, and requirements.

7. Content and Intellectual Property

  • Teachers retain ownership of the content they upload, create, or make available through the platform.
  • By uploading or submitting content, users grant Anyclazz a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and promote that content within and in connection with operating, improving, securing, and marketing the platform.
  • Users may not copy, scrape, reproduce, republish, distribute, or exploit platform content, branding, or materials without prior authorization from the applicable rights holder.

8. Platform Moderation and Enforcement

Anyclazz may review listings, profiles, messages, videos, images, and other content or conduct for compliance, trust and safety, legal risk, fraud prevention, platform quality, payment integrity, or customer support.

  • Remove or restrict content that violates these Terms or applicable law
  • Issue warnings or temporary restrictions
  • Suspend or terminate accounts involved in misconduct, fraud, repeated cancellations, abuse, payment circumvention, or safety risks

9. External Payment Providers

Payments are processed by third-party providers, such as Stripe. Users agree to comply with the terms, verification requirements, and policies of the relevant payment provider. Anyclazz is not responsible for errors, outages, verification delays, failed transfers, chargebacks, holds, or other issues caused by a third-party payment processor.

10. Privacy, Marketing Communications, and US Consumer Rights

The collection and processing of personal data are governed by the Privacy Policy. For users located in the United States, including California residents, Anyclazz may be subject to additional privacy and consumer protection requirements under applicable federal and state laws.

  • Anyclazz does not sell personal data as that term is traditionally used; however, users should review the Privacy Policy for any rights that may apply under the California Consumer Privacy Act (CCPA) or similar laws, including rights to know, access, delete, correct, and opt out where applicable.
  • Marketing emails and similar promotional communications will be sent only in accordance with applicable law, including consent requirements where applicable and the CAN-SPAM Act in the United States.
  • All marketing communications will include a clear method to unsubscribe or opt out, and Anyclazz will honor applicable unsubscribe requests as required by law.

11. Limitation of Liability

To the maximum extent permitted by law, Anyclazz acts solely as an intermediary platform and shall not be liable for:

  • The quality, accuracy, legality, suitability, safety, or outcome of classes
  • The conduct, statements, omissions, credentials, or acts of teachers, students, or third parties
  • User-generated content, disputes, cancellations, no-shows, or off-platform arrangements
  • Technical errors, downtime, interruptions, bugs, malware, viruses, payment processor failures, or loss of data beyond what cannot be excluded by law

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

12. Dispute Resolution

12.1 Users in the European Economic Area (EEA)

These Terms are governed by Spanish law. For disputes involving EEA users, the courts of Madrid, Spain shall have jurisdiction unless mandatory consumer protection law provides otherwise.

12.2 Users in the United States and Other Non-EEA Jurisdictions

To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the use of the platform shall be resolved through binding individual arbitration administered by a recognized arbitration body, such as the American Arbitration Association (AAA) or JAMS, rather than in court.

  • Arbitration will take place in a location reasonably convenient for the user, or remotely where permitted by the applicable rules.
  • Each party retains the right to bring an individual claim in small claims court where the claim qualifies and remains within that court's jurisdictional limits.
  • To the extent permitted by law, disputes must be brought on an individual basis and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding.
  • Before commencing arbitration or court proceedings, the parties agree to make a good-faith effort to resolve the dispute informally by contacting info@anyclazz.com.

13. Termination

Anyclazz may suspend, restrict, or terminate access to the platform, remove listings, withhold features, or take other reasonable action for violations of these Terms, suspected fraud, legal or regulatory risk, safety concerns, repeated abuse, payment circumvention, or operational necessity.

14. Changes to the Terms

Anyclazz may update these Terms from time to time. Material changes will be communicated through the platform, by email, or by other reasonable means. Continued use of the platform after the effective date of the updated Terms constitutes acceptance of the revised Terms, except where applicable law requires a different form of consent.
